How to verify HOA obligations on an Alberta title

A practical sequence for proving whether an address really carries an association fee.

Start with the title, not the map

Community boundaries, marketing maps and association boundaries are not the same thing. Start from the Certificate of Title for the specific parcel and work outward.

  • Obtain a current Certificate of Title for the legal description.
  • Order copies of each registered instrument.
  • Identify any encumbrance, caveat or restrictive covenant naming an association.
  • Write to the named association and ask for written confirmation of status, fee class and balance.
  • Have a real estate lawyer review the instruments.

When the answer is unclear

If the title and association responses do not clearly settle the question, treat the property as requiring title / association confirmation rather than assuming either way.
